General Terms and Conditions of Sale

The present general terms and conditions of sale apply to all products sold on the website www.duhaut-paris.com, and they govern all orders placed on the website by non-commercial individuals referred to as "the Client."

Duhaut Paris reserves the right to modify the General Terms and Conditions of Sale at any time.

Article 1 - Purpose

The General Terms and Conditions of Sale are intended to define the rights and obligations of the parties in the context of online sales of products by Duhaut Paris.

Article 2 - Orders

The General Terms and Conditions of Sale govern the sale of products as of the date the order is placed by the Client.

Placing an order for a product offered on the website www.duhaut-paris.com constitutes full acceptance of the General Terms and Conditions of Sale, which the Client acknowledges having read prior to placing the order.

The order process is as follows:

  • Create a shopping cart by selecting the desired products with options for colors and quantities;
  • Validate the shopping cart;
  • Identify yourself by entering your email address and personal password, or by creating a new customer account;
  • Indicate the chosen delivery method;
  • Finally, select the chosen payment method.

Once the payment method is selected, the Client must proceed to payment on the secure interface, which will formally and definitively finalize the sales contract between the Client and Duhaut Paris.

The online provision of the Client's credit card number and the final validation of the order will serve as proof of the order and make the amounts due for the selected products payable.

The information provided by the Client when placing the order is binding: in the event of an error in the recipient's details, the seller cannot be held responsible for the inability to deliver the product.

Order Confirmation:

Three emails will be automatically sent to the Client at the email address provided during registration:

  • The first email confirms that the order is validated.
  • The second email confirms that the payment is validated.
  • The third email will contain the invoice.

Article 3 - Prices

Prices are expressed in euros and do not include shipping fees.

The price indicated in the order confirmation is the final price, expressed inclusive of all taxes, with no VAT (Article 293B of the French Tax Code) for France and EU countries.

Article 4 - Availability

Duhaut Paris cannot be held responsible if the stock differs from what is indicated on the website www.duhaut-paris.com at the time of the order.

Duhaut Paris is only obligated to honor orders received within the limits of available stock.

Product availability may vary within a single day depending on sales volume, despite frequent updates.

Article 5 - Payment

The Client can pay for their order online by credit card (Carte Bleue, Eurocard-Mastercard, and Visa) or via PayPal.

The Client guarantees that they have the necessary authorizations to use the chosen payment method when validating the order form.

Payment for purchases is debited from the Client's account at the time the order is processed.

Duhaut Paris takes all necessary measures to ensure the security and confidentiality of data transmitted online.

The transaction is carried out via the secure Stripe platform, which alone has access to the banking information provided on the site at the time of payment.

Duhaut Paris reserves the right to suspend any order management and delivery in case of refusal to authorize payment by accredited financial institutions or in case of non-payment.

Duhaut Paris reserves the right to refuse to deliver or honor an order from a Client who has not fully paid for a previous order or with whom a payment dispute is being resolved.

Please understand that we are not responsible for shipping carrier delays and for delay due to Border Customs . 

Delivery times are always given as an estimate. Exceeding these times cannot justify canceling the order without prior agreement from Duhaut Paris.

The Client is delivered to their home. In case of absence, the Client or the recipient of the ordered product will receive a notice of passage from La Poste or the carrier, allowing them to collect the ordered products at the nearest post office within fifteen days.

The Client is required to check, in the presence of the delivery person, the condition of the packaging of the goods and their contents upon delivery. If the Client has any doubts about the condition or contents of their package, they must report any damage, note all claims and reservations, or refuse the goods by immediately filing an anomaly report with La Poste or the carrier and notify Duhaut Paris within 48 hours.

Duhaut Paris disclaims any liability for extended delivery times caused by the carrier, particularly in cases of product loss, weather conditions, or strikes.

Article 7 - Returns

In accordance with Article L 121-16 of the French Consumer Code, the Client has a period of fifteen days from the date of receipt of the items to return, at their expense, the products ordered for a refund. 

 

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

Should you wish to return the artwork, you can contact us at : infoduhautparis@gmail.com. If your return is accepted, you have to find a shipping company as well as pay for the return shipping on your own and send it to:

Once we have received the product and it is all good we will make the refund and you will receive a full refund for the product - but minus the delivery charge. 

Items sent back to us without first requesting a return will not be accepted. You can always contact us for any return questions at infoduhautparis@gmail.com.

Damages and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items
Certain types of items cannot be returned, like custom products (such as special orders or personalized items). Please get in touch if you have questions or concerns about your specific item.

Unfortunately, we cannot accept returns on sale items or gift cards.

Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Shipping and return costs are the responsibility of the Client.

Duhaut Paris undertakes to refund the total amount paid within fourteen days from the receipt of the products or from the date of withdrawal, provided that they are new and have never been worn.

Article 8 - Information

Duhaut Paris is committed to respecting the confidentiality of personal data provided by the Client on the Site and to processing it in accordance with the French Data Protection Act of January 6, 1978. The Client has the right to access their personal information. Upon request, this information can be communicated and, in case of error or modification, corrected.

The Client's personal data will not be disclosed to third parties unless explicitly requested.

Article 9 - Liability

In no event shall Duhaut Paris be held liable for improper use or damage related to exceptional weather conditions. Duhaut Paris cannot be held responsible for any damages, whether material, immaterial, or bodily, that may result from the malfunction or improper use of the products sold. Claims or disputes will always be received with goodwill, as good faith is always presumed in those who take the time to present their situation. In case of dispute, the Client will contact Duhaut Paris to seek an amicable solution.
